This was an open letter to the Mayor of Chaska printed in the Chaska Herald Editorials on January 15th, 2009.
Mr. Mayor,
I am not sure what is in play with this appointment to the Southwest Transit Commission.
In my eight years as a councilmember I cannot recall one time where we did not re-appoint the current commissioner to any of our commissions. Our Commissions are filled with dedicated people that are not paid and donate their time to the City.
Putting me into a position of jumping through hoops for reappointment is not fair and unprecedented. I followed the rules and submitted my interest to the council on-time and showed up on Monday night for the interviews. On Monday you indicated that you had someone call with an interest in serving on the commission, however they could not make the interviews that evening and the appointment would be delayed until January 26th .
Your email this morning let me know that Bob Roepke was the person interested in serving on the SWT Commission.
Issues like this cause our citizens to raise an eyebrow to what they may call the good ole boys network.
The fact that Mr. Roepke is an investor in the Ed Campus and that if the project moves forward SWT will play a pivotal role in establishing a transit center on the site would in my opinion create a huge conflict of interest for him. Transparency in government is necessary in Chaska and is needed now, not later.
I extended my hand to you after my last council meeting to figure out how I can help the City bridge the gap between Old Chaska and New working together with you.
The fact that this decision is being delayed and an exception was made to delay the decision when the interviews and applications for these positions was clearly printed in the paper makes one wonder if the process would be delayed if it was anyone else other then Bob Roepke.
If you meant what you said during the campaign about communication and having a transparent government you clearly are off on the wrong foot in less than two weeks into your new term.
This is going to take more than sending out an informational letter via email and having a television show on Channel 15. On this proposed TV show are you planning to have regular citizens? Will you be putting people on that have opposing viewpoints? This is what transparency is all about and if implemented in Chaska it will go a long way to keeping people informed of the decision making process in our community.
I can promise that if I had been elected Mayor my first phone call would have been made to you, so that we could discuss how to keep you involved and not to excommunicate you by making a political move with commission appointments.

These type of actions happen all of the time in Chaska and it is time for the people to Stand-Up and say no more!
More and more people are now aware of the politics that are in play in Chaska and more are speaking out. We need to hear your voices!
Change is coming to Chaska. As much as the Good Old Boys that have run our town for decades hate to admit it. The last election was very close and I beleive that in the next several years we will be lucky enough to have fresher perspectives elected to our City Council.
The new people elected to the Council in the past 4 years have not had the guts to stand up for what is right and instead fall in-line with the Mayor's or Staff's wishes.
Councilmember Chris Schultz has turned into a fizzle. He seemed to have so much promise when elected and in the past two years I have not seen him stand up in opposition to anything. I have seen him chastize fellow Chaska citizens and talk a good game but in the end he votes with Pokorney and Van Eyll.
Councilmember Businaro asks many great questions but he too does not stand up and take an opposing view point or dissent.
Hopefully Councilmember's Boe and Ford will have the courage to represent the people and what is right and not fall in-line with the Good Old Boys.
One more note. Mayor Van Eyll has been asked on several occasions where he is employed and by whom. He has yet to answer these important questions and if there may be a conflict of interest.
Come'on Mayor you cannot remain silent on this forever.

This city has been doing its stuff behind closed doors for years and years.
1. Council agendas were one page until two months ago. Thank you, Gino and Matt for providing more information.
2. The new city administrator was annoited in an illegal meeting.
3. The newspaper has learned to say nothing, otherwise, they will not receive their weekly feeding.
4. Appointments to commissions are carefully screened. Last year, a planning commissioner who only had one year left due to term limits was asked to resubmit before appointments were made. This year, his wife was named to replace him. A extremely well qualified candidate was snubbed.
5. The city web site has been in shambles and disrepair for two plus years-but nobody takes responsibility.
6. The city run internet service has been oversold and under delivering for years.
7. Backroom deals are pervasive, and a way of life.
The GOBS have been doing it "their way" for so long that they do not even recognize the failings of their methods.
The GOBS in DC are leaving their city tomorrow.
We need to do the same in Chaska. We need to put the spotlight and add some sunshine to all the hidden relationships in the City.
When is the Mayor going to explain his new job?????

The Mayor has already voted on the new Goodman project which Dave Pokorney is their consultant. The project is a good thing for Chaska Seniors so I am not knocking the Goodman Group.
what I am questioning is Mayor Van Eyll's vote to move the project forward.
If the rumor is true and he is working for Dave Pokorney's company Comunity Power should he recuse himself. Even if the City Attorney says he does not have too? In my opinion it is the hint of a conflict or an appearance of a conflict that should cause him to bow out of the vote. If Pokorney (this is still a rumor until the Mayor answers the question of who he works for) is signing his checks does that not cause the appearance of a conflict for the Mayor?
Of course in this town the GOBS beleive they can do what they want whenever they want and no one will care.
Well they better get ready because there are many of us that do care and are going to continue to ask questions.
Again I ask why is the Mayor silent?
I remember reading a letter to the editor in the Chaska Herald print edition about a couple of months ago from a Chaska resident asking other questions of the Mayor. He has yet to respond.

Both "Chaskacounterpoint" and "Henry" choose not to be transparent themselves by cowardly hiding behind a screen name while publicly criticizing several elected officials. I guess transparency only applies to others.
Hears to Mr. Rohe for taking a different position, yet providing his name so those reading his words know who wrote the criticism and may understand his perspective. Isn't "Chaskacounterpoint's" credibility suspect if he/she calls out several City Councilmen as "gutless", but doesn't have the guts themselves to reveal their name? I believe most would respond affirmatively.
The cowardly KKK which was often composed of prominent public figures, hid behind their hoods to do their despicable acts.
The spineless Hamas terrorists fire missiles and then hide among the innocent.
But gutless "blog" posters attack and attempt to destroy or discredit others while hiding behind anonymous screen names and are not accountable for their comments.
Why would anyone even bother to show YOU respect and respond to your questions when you don't have the decency to let them know who you are?

Just a reminder that a great American Benjamin Franklin often used aliases for letters to the paper.
Franklin wanted to write for the his brother's paper but he knew that his brother would never let him. After all, Franklin was just a lowly apprentice. So Ben began writing letters at night and signing them with the name of a fictional widow, Silence Dogood. Dogood was filled with advice and very critical of the world around her, particularly concerning the issue of how women were treated. Ben would sneak the letters under the print shop door at night so no one knew who was writing the pieces. They were a smash hit, and everyone wanted to know who was the real "Silence Dogood."
In 1729, Benjamin Franklin bought a newspaper, the Pennsylvania Gazette. Franklin not only printed the paper, but often contributed pieces to the paper under aliases. His newspaper soon became the most successful in the colonies.
In 1733 he started publishing Poor Richard's Almanack. Almanacs of the era were printed annually, and contained things like weather reports, recipes, predictions and homilies. Franklin published his almanac under the guise of a man named Richard Saunders, a poor man who needed money to take care of his carping wife.
So if this is the company we keep to try to effect change in our comunity I am proud to follow in Franklin's footsteps.

Of course none of Franklin's actions you describe were intended to harm others. He had guts, and class. Maybe you could emulate those traits as well.
Lest you forget Ben Franklin said, "He that is good for making excuses, is seldom good for anything else."

If you take some time and read some of his letters you will see he was highly critical of local politics, women's rights and the world.
If you cannot see that we have a problem in Chaska with a certain group of people controlling everything then we will never be able to have a meaningful discussion.
You of all people should understand how to effect change as I beleive you were the one who found the loop hole in the Jonathan By-Laws and came with enough voting residents to throw most of the elected board out. You certainly were not happy with the board and I applaud your efforts to effect change.
My biggest issue is that with this group of people controlling Chaska they hide behind the word Community. When they now are working to develop Chaska and profiting from their actions.
One could say this is America and that is how it works. We are a citizenry of capitalist and these people have every right to use their influence and experience to make money.
I am OK with that but don't be ctricial of others that do not share your vision for Chaska. These individuals sit back and chastize our fellow citizens for taking opposing viewpoints.
If these indivduals would stand up and say yes I am making money off of what happens developmentally in Chaska then it would be out in the open.
I have a couple of questions for you.
Let's say hypothetically that the Mayor of a town works for a company that will have a product to sell to a development being built in that town. And that his boss is also a consultant for that project being built. Doesn't that mayor have the duty to recuse himself from any vote pertaining to that project? Wouldn't the appearance of a conflict exist at that point?

For one, I'm unable to see any disagreement we have regarding Ben Franklin.
Where we MAY disagree is that you seem to think it's acceptable to take public pot shots at elected officials hiding behind a screen name. I find it cowardly. We can agree to disagree with this position, but again, I don't see any disagreement on Ben Franklin. Agreed?

I don't know that I "cannot see that we have a problem", I'm just not sure what I'm seeing is the same thing you THINK you're seeing. You've already given a clear indication what you THINK you see may be totally incorrect. What am I talking about you might ask? In 1/2 of one sentence, you provided FOUR, count`em four, misstatements. That certainly may be a record, "chaskacounterpoint". You deserve a thorough explanation. Here are the FACTS:
1. You stated, "...you were the one who found the loop hole in the Jonathan By-Laws..."
Well "chaskacounterpoint", rest assured, it wasn't me who identified what you call a "loop hole".
2. Secondly, it clearly isn't a loophole. According to Merriam-Webster online, a loophole is "an ambiguity or omission in the text through which the intent of a statute, contract, or obligation may be evaded." This is CLEARLY not the intent of the Associations By-laws. The By-laws read:
ARTICLE V, Section 3. Removal. Any director may be removed from the Board, with or without cause, by a majority vote of the members of the Association voting thereon at a duly called meeting of the Association.
Certainly you will agree "chaskacounterpoint" this is NOT ambiguous, nor an omission. It is concisely stated and most understand it was written into the By-laws intentionally to allow the Association Membership to remove board members who are acting irresponsibly or detrimentally to the well being of the Association. So to call the removal a loophole is very inaccurate!
3. You then stated, "...and came with enough voting residents to throw most of the elected board out." I came to the meeting knowing only one other person absolutely knew I was going to put forth a motion. That was the gentleman who seconded the motion. There were two other individuals I discussed what we were considering, but they didn't know for sure until the motion was made. The last time we spoke there were too many unanswered issues "in-the-air" that needed to be resolved. There were a total of 8 people who I bounced the idea off of in late January 2008. These eight include the three previously mentioned. However, after that discussion, it was left as just an idea that may have no merit. No other conversations with this entire group occurred.
An interesting point of irony is that it was my intent to send a letter to all Jonathan residents inviting them to come to the Annual Meeting to vote on the motion. I was intending to let all the residents know about the motion and explain why it was necessary. However, the board delayed providing me with the address list as long as possible and ultimately provided very little time to get a mailing out to the membership.
You may recall the President providing a sad excuse for the delay saying he even went to the Association's attorney to see if he could provide me with the mailing list because "another owner had requested the list earlier". Please note the attorney stated in a letter to the board back in May 2007 that the address list must be made available. The board eagerly voted to put the letter on the Association's website because as one board member said, it would embarrass me. In fact it proved my point. The board was clueless. They had an answer to the address issue in May 2007, posted it to the website; received another request from another individual in October 2007 and the President took his valuable time to ask the attorney if it was necessary AGAIN in late January 2008. Talk about a waste of Associations money!!! All he had to do was read the May 2007 letter. This is just one example of how incompetent and mean-spirited the clowns were.
So, to be fair to all parties, something that seemed to escape the ousted board, I choose not to tell anyone other than those previously mentioned about the planned motion. As you may know, the PBJ has an extensive email address database. I certainly could have used it to communicate the planned motion to over 300 Jonathan residents, but I decided against it. Some actually do want to be fair.
So "chaskacounterpoint", your premise is incorrect. I did NOT come with "enough voting residents" to remove those wasting the Associations money. However, if just the eight who had some information showed up at the meeting, it still would have passed. As you may know, the Association invited over 3,000 people to the meeting. I invited no one. Only fifty chose to attend. 96% of those attending didn't know the motion was going to be made. With the apt vote's that were present, the vote was not as previously reported by this paper, but was actually 82 for removal and 4 against and two of those four were the ousted board members. Shouldn't they have reclused themselves from the vote? Of course they should have, but it wasn't like them to act responsibly. If they had the vote would have been 82 - 2.
4. You then stated, "...to throw most of the elected board out." Again you are mistaken. Using the word "elected" is questionable at best. Here’s why:
Six board members were removed. One was placed on the board "illegally" or "non-compliantly". He was put on the board as a write-in candidate. The Association's Governing Documents do not permit "write-in" candidates, as all board candidates MUST be nominated. He chose to avoid having his name made public. When this issue was raised at the very next Board Meeting, the President said she'd forward the issue to the Associations attorney, which she did. The attorney came back and said "write-in" candidates are NOT permitted. This board member was sitting on the board illegally. The attorney's response was hidden from other board members and those who knew about the attorney's opinion choose to ignore the opinion they paid to obtain. So I wouldn't agree he was an "elected board member"
One of the removed board Members never ran for a board position. He was appointed to the board to fill a board vacancy. So, I wouldn't call this board member "elected" either.
Three of the other four board members were placed on the board due solely to an incorrect tabulation of apartment votes. Several on the board knew the tabulation was incorrect at the time and two current board members clearly know how this occurred. Talk about corruption! You may not be aware but in January 2008 I asked the Chairperson of the Election Committee (or Nominating Committee), the one who established the election rules (and gave them to the Women's League of Voter's to make the elections look legitimate in 2006 and 2007) if 100 homeowners voted in the election, how many votes would the apartment owners have allocated. His response was 300. He was corrected by another board member who said, 297. I was criticized for raising the question. "Chaskacounterpoint" you may be surprised to know that the answer is 98. So, when one person who is hell-bent on destroying the Association wins by 7 votes, and which he received all of the apartment owner votes, it's difficult to accept that he was "elected". Certainly a civic-minded person like you would agree. This "new math" was also used to get the other two board members on the board. Again, "elected" is a stretch.
That leaves one board member that was duly and appropriately removed, who MAY have been appropriately elected. But we'll never know for sure because an employee of the Association revealed that one of the removed board members shredded some, if not all, the ballots. I wonder why he would have shredded the ballots if the board members were appropriately elected and the apartment votes correctly tabulated. Again, I'm willing to bet a civic-minded person like yourself would be outraged, "chaskacounterpoint".
I do appreciate your opening the door to some of these issues so I could provide clarity to some of the rumors circulating in the community. These are usually circulated by those with just a nugget of information and often choose to include their own opinions and state them as facts.
So, provided the above information, you may understand why I'm a little skeptical as to your assertions about city officials. You provided some information as if it was factual and as demonstrated, it is not.
If people's rights are being violated, or if corruption exists, I'm all for effectuating change. But I encourage you to make sure your "facts" are accurate and burn the hood. It's much more respectful.

Back to page topI think it would be useful for the Mayor to clarify his relationships with Pokorney and Roepke. Frankly, this is something the Chaska Herald should be doing -- investigating the possible conflicts of interest, and either publicizing their existence or debunking them.
I think Rohe is correct that Roepke -- given his EdCampus involvement -- should not be on the SWTC. Van Eyll, if working for Pokorney, shouldn't be voting on issues that Pokorney has consulted on. And Ford's EdCampus investment calls into question whether he can be impartial on the development of the rest of the Bio Zone.

And the Herald needs to step up with their reporting. Where there is smoke, there is usually fire. This is a situation that could be cleared up very quickly.
I for one would welcome an open letter from Van Eyll or Ford clarifying their involvement with this project.

What I find most disturbing in your letter is the widespread practice of the director soliciting and choosing who will be on the committee that supervises and advises the group and oftentimes determines the continuing employment or salaries of the Director.
The SW Transit Commission Director believes it is job to select the Chaska representative.
The planning director for the City chooses his commission members.
The park director for the City chooses his commission members.
It took years to get a commission created to examine the Golf Course operation.
Quite frankly, this is just another way that the GOBS stay in charge. Professing openness while practicing inside politics.

Back to page topI agree that the letter from Roepke this week only raised more questions. Why would Mayor Van Eyll send Mr. Rohe an email indicating Roepke's desire to serve on the Commission, only a couple of days before the letter was written by Mr. Rohe to the newspaper?
Based upon that timeline either Mayor Van Eyll is sublined to Roepke's request to withdrawal his name or Roepke never articulated his desire to step out of the process.
If Mr. Roepke had withdrawn his name long before the letter was written, according to his letter to the editor why then would the process have been delayed only a few nights earlier at City Council meeting. The timeline doesn't match Roepke's letter.
I have heard that there is more at play with this appointment to the Southwest Transit Commission.
I have heard that Councilmember Chris Schultz is jockeying for an appointment as the elected representative pushing Greg Boe out at the newly elected Councilmember from Ward 2. Greg has served for the past year as the Citizen Representative. It is possible that they may appoint two councilmembers eliminating the Citizen representative.
The council can do this. It would put Chaska in a different situation as EP and Chanhassen have one elected and one citizen appointed to the Commission. Not two elected representatives.
Other then the fact that Mr. Rohe has been on the commission and the Chairman for the past year, the Council seems oblivious to appoint someone without experience, which is absolutely needed on the Commission with cutbacks and the possibility of Opt Outs being eliminated all together.
The newspaper was right this week when they said that downtown needed leadership. I remember that the Mayoral candidates spoke a lot about leadership. Mr. Rohe pointed out that he thought Mayor Van Eyll lacked leadership capabilites. Maybe others are now begining to realize that Van Eyll is not the strongest strategic leader that Chaska needs.According to Van Eyll's comments on election night he sees no reason to change his leadership style. Friends, it may be a very long two years.

"It's in the start up stages," he said, but the idea would be to bring three to four entities together to sell "power as a backup."

Not unexpected but the City Council last night appointed Jennifer Wolf to replace Jay Rohe on the Southwest Transit Commission.
Ms Wolf has served on other Commissions for the City and is a bus rider.
What is lacking with this appointment is that the Commission will be put through a very tough year. Someone with Rohe's knowledge of the political process and St. Paul contacts would have been invaluable to the Commission.
Mayor Van Eyll and Councilmember Chris Schultz were the drivers behind making this appointment. Schultz's wife was on the Mayor's re-election committee.
The Mayor cited Rohe's letter to the Editor as the main reason he could not support Rohe for re-appointment. Wow, the Mayor who professes to make decisons that are in the best interests for the entire community really missed the ball on this one.
The Mayor and Councilmember Schultz have set a preceedence here with commission appointments. Either agree with them 100% or you will not be re-appointed!
Mr. Mayor enjoy your day and using your power to excommunicate Mr. Rohe from serving. I guess it really is true that you cannot have an opposing viewpoint in Chaska.
If you do you will not be asked to serve, interact or be involved with our City.
This is exactly what the newer people experience in Chaska so they just stop being involved. It is wrong and needs to change.
